Present:  M. Dempsey, T. Grim, S. Benanti, T. Schaefer

Opened meeting 7:20 pm.

97 R King St. - Informal hearing.  

Rich Bowden still owes money from a consultant’s bill.  We will send a copy of monies paid and what is owed for the consultant (Marc Jacobs).  For the record, Tom Schaefer is an abutter and any comments made are only abutter comments, not as a Commissioner.  

Rich Bowden is looking for support from the Conservation Commission because the town bylaw doesn’t address common driveways.  He would like to put in a common to 2 lots, rather than putting in 2 driveways.  Or, extending the cul-de-sac with 2 separate driveways with their own frontage.  He has not been before the Planning Board as yet.  M. Dempsey said it is not jurisdictional to ConCom unless it affects the environment.    R. Bowden said it’s along the 25’ buffer zone with hot top.  Both within the 100’ buffer either way.  If he extends it, one driveway will stay out of 25’ buffer.  M. Dempsey said he needs to go through the Notice of Intent process, however, ConCom will consider it because there may be an environmental good reason for it.  ConCom is open to it.  R. Bowden asked if the storm water management area can be in 25’ ?  It can be done but needs to be treated, ie storm septors, and make sure there are no solids.  Informal hearing closed 7:31 pm.  

7 Bare (or Bear) Hill Road (aka Amber Estates) - GRDA -
Present:  Terry Trudel

A site visit was conducted on January 21, 2006.  Received a check for $75.00 fee.  Hearing opened 7:32 pm.  M. Dempsey said there are no issues.  T. Trudel needs a letter for the review engineers.  M. Dempsey made a motion that ConCom close the hearing with no findings, and a letter to be issued to that effect.  T. 86 School Street - GNOI -
Present:  Kevin Cuniff
Terry Grim recused himself from this hearing.

Hearing opened 7:37 pm.  K. Cuniff submitted site plans.  He said it’s 76’ from the house to the culvert (drainage ditch).  After the addition, it will be 60’.  M. Dempsey went to the site and said he didn’t feel there was any impact at all.  M. Dempsey suggested he put up a line of hay bales along the stream where he’s doing the work. Line of hay bales 25’ away from the drainage ditch for a total distance of 80’, centered on the deck and addition.  K. Cuniff was told to call ConCom for inspection.  

K. Cuniff submitted a proposal to commence work right away during the seasonal restriction.  M. Dempsey asked what advantage is there to granting him the waiver?  The area is muddier in the spring time and more susceptible after May.   K. Cuniff requested a waiver to excavate 7 days and building for 3 weeks.  T. Schaefer said it’s not a site that there’s an issue.  K. Cuniff was told that no work is to be done if it’s particularly rainy that day.  There were no objections to the waiver from the Commissioners.  It is not a sensitive site.   T. Schaefer suggested a fee reduction for this small addition to a weekly fee.  K. Cuniff was told he will need to have a site visit after the excavation.  M. Dempsey made a motion reduce the fee to $100/week of excavation and $50/week for outside work.  Kevin Cuniff‘s cell:  978-430-7995  .  S. Benanti made a motion to grant the waiver along with waiver fees as discussed.  T. Schaefer 2nd.   Note: Waiver from the seasonal restriction for 1 week excavation and 3 weeks exterior construction for a reduced fee of $250.  All in favor.  Unanimous. 1 abstention.   Hearing closed 8:09 pm.
ConCom Business - Minutes
M. Dempsey made a motion to accept the minutes from January 4, 2006.  T. Schaefer 2nd.  All in favor.  Unanimous.

ConCom Business - MACC
There is an upcoming meeting of MACC (Mass Association of Conservation Commissions) on Saturday, March 4, 2006 in Worcester, MA.   

55 Center St - NOI/GNOI -
Hearing opened 8:10 pm.
Present:  George Charest, Jack Sullivan, engineer.

G. Charest submitted green cards and tear sheets and financial form.  J. Sullivan said G. Charest would like to construct detached 26 x 34 garage 51 ½’ from the wetlands.  He had the wetlands delineated by Botanist Allison Mackay, Conservation Agent for North Andover.  There is an existing gravel driveway that accesses the site and an existing gravel drive that presently encroaches on the 25’ no-cut zone.  J. Sullivan suggests to reestablish the 25’ no-cut zone, and move the driveway outside the 25’ no-cut, and provide plantings at the buffer.  He suggested using silt fence and hay bales.  2 trees would be removed as part of the project.  Construction of retaining wall based on the grading.  The garage would be built at grade, as a garage under.  All proposed work falls within 100’ buffer zone.  M. Dempsey asked if the driveway would be paved or gravel?  G. Charest said it would be gravel.  T. Grim asked him what he was trying to achieve.   G. Charest said the garage will be over-under, with a concrete slab above and storage below.  There is a site visit this Saturday, February 18th, at 8:00 am.  Hearing continued to March 15th, 7:30 pm.  It was determined that 2 trees would be less than 40% of the entire project.  Requested suggestions on plantings.  Erosion controls will be hay bales and silt fence along the edge of the existing gravel.  G. Charest said the gravel will be spread by machine.  Hearing closed at 8:35 pm.  

T. Grim made a motion to close the meeting.  S. Benanti  2nd.  All in favor.  Unanimous.  8:36 pm.
